• Personal Data means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
• “Special Categories” means Personal Data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person’s sex life or sexual orientation

LHH is a global organization, and in order to provide our products and services to you, we may send and store your personal information outside of the country where you reside or are located. When we transfer your personal information to other countries, we will protect that information as described in this Privacy Notice and in accordance with applicable law.

This means that if you are a resident of, or located in the European Union, Switzerland or the United Kingdom, your data can be transferred and processed in other countries, some of which have not yet been determined by the European Commission to have an adequate level of data protection. For example, their laws may not guarantee you the same rights, or there may not be a privacy supervisory authority there that is capable of addressing your complaints. Lee Hecht Harrison LLC (“LHH LLC”) located in the United States, complies with the E.U.-U.S. and the Swiss-U.S. Privacy Shield Framework as set forth by the US Department of Commerce regarding the collection, use, and retention of Personal Data transferred from the European Union, the United Kingdom and Switzerland to the United States, respectively. LHH LLC has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. In compliance with the E.U.-U.S. and Swiss-U.S. Privacy Shield Principles, LHH LLC commits to resolve complaints about your privacy and our collection or use of your Personal Data. LHH has further committed to refer unresolved privacy complaints under the E.U.-U.S. and Swiss-U.S. Privacy Shield Principles to an independent dispute resolution mechanism, the BBB EU PRIVACY SHIELD, a non-profit alternative dispute resolution provider located in the United States and operated by the Council of Better Business Bureaus. Please note that if your Privacy Shield complaint is not resolved through the above channels, under limited circumstances, a binding arbitration option may be available before a Privacy Shield Panel.

With respect to personal data received or transferred pursuant to the Privacy Shield Frameworks, LHH is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. In certain situations, we may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Please note that, despite the Court of Justice of the European Union’s invalidation of the EU-US Privacy Shield Framework as a mechanism for transfers of personal data between the EU and the U.S. in Case C-311/18, LHH intends to maintain its self-certification under the EU-US Privacy Shield Framework and remains committed to complying with the Privacy Shield Principles. We will only send marketing communications to you, as an individual, if you have explicitly consented to us doing so. If you do give explicit consent, you have the right to withdraw such consent. B2B Communications. If you represent our prospect, partner or customer, either prior to entering into an agreement with LHH or during a business relationship between LHH and the legal entity which you represent, we may process your basic contact details (e.g. your name, surname, job position, company name, e-mail, and phone number) so far as necessary to carry out our joint business relationship. When we can legally do so, we may augment this information in order to assure that it is accurate. This processing of your personal data is based on our legitimate interest in maintaining and developing our business relationship and customer base, promoting our products, services, and customer loyalty programs. Generally, you cannot opt out of these sorts of communications which are not marketing-related but merely required for the relevant business relationship.

Automated Decisions

We do not make any automated decisions solely through automated means without implementing suitable measures to safeguard your rights, freedoms and legitimate interests.

The portals that are part of your services do not respond to Do Not Track browser options.

If you do not provide us with the Personal Data we request, or do not agree to our collection of your Personal Data, we may not be able to provide our services to you or respond to your requests for information or services.

The Company can (and in some circumstances must, depending on the type of data) keep your data for several years after your services have ended. Generally, we retain personal information for 3 years. We retain sensitive personal data for no longer than is reasonably necessary.

We usually disclose your data to third parties to complete the purposes set out above. We disclose your data in the circumstances set out below, all subject to the same rigorous data protection standards as we follow ourselves.

We may disclose the Personal Data we collected about you to:

• Affiliates: We disclose Personal Data to our affiliates to provide portions of the services. For instance, we share Personal Data with our affiliates Lee Hecht Harrison LLC in the United States. We share with other affiliates and partners who may be providing the services in the country of origin.
• LHH Licensees/Service Partners: We may share Personal Data with Licensees and Partners if they are providing any portion of the related services to you.
• Licensees are third parties who are authorised by LHH under a Licensee Agreement to use the intellectual property and marks of LHH to provide services to LHH customers.
• To other entities belonging to the Adecco Group (i.e. any companies directly or indirectly controlled by Adecco). A list of Adecco Group companies is included here www.adeccogroup.com/worldwide-locations/ including their suppliers, contractors and agents, which may be involved in the provision of services to you.
• Service Providers: We share Personal Data with third party service providers to provide supplemental features of our services such as the following:
  • Online training courses
  • Digital learning solutions
  • Personal assessments and evaluation tools
  • Interview audio/visual tools for Interview practice
  • Premium databases for use in researching topics or subjects relevant to Career Transition Services
  • Scheduling tools to communicate with coaches, counselors and set up meetings
  • Audio, video and/or web-conferencing tools
  • Resume parsing, development, analysis, etc.
  • IT development, maintenance, hosting and support.
• Virtual Career Fair Providers: These companies provide the opportunity to enter a career fair with potential employers online.
• Professional Service Provider Consultants: We may use professional service consultants to provide you with coaching, counselling, resume advice, or other advice related to your services.
• Law Enforcement/Government Agencies: We may disclose your Personal Data if required to comply with law enforcement or legal process, such as a court order or subpoena, or if needed to protect ourselves or other, for example, in a dispute or against fraud or illegal activity. We may also share Personal Data if required as part of due diligence relating to (or implementation of) a merger, acquisition, change in service provider or other business transaction.
• Hiring Community: We will share your resume/cv within LHH proprietary digital job boards in order to give you the opportunity to be actively placed in specific privately published career opportunities. Note that when we do so, the hiring community may contact you from the contact information on your resume/cv or profile to such boards. However, NEVER should any hiring community person ask you for money! Please contact us (see the Contact Us section) if anyone asks you for money regarding the services.
• Coaching Certification Board: If the services are Leadership Development or Coaching, we may disclose your name, job title, dates of coaching, and numbers of hours coached, as well as the name of your coach, to third parties for certification purposes such as disclosing your name and contact details, and the length of time you were coached, so our coaches can maintain their certifications with certain third party certification boards. This is done only with your consent.
• Employer/Former Employer:
  • Career Transition/Talent Development Services: If the services are provided to you by your employer (or former employer), we may provide them with limited reporting about the services rendered to you. Note: If you are enrolled in a confidential consulting programme as part of our voluntary leave or voluntary redundancy career transition service, we will not provide any Personal Data about you or your use of the services to your employer.

• Right to access and obtain a copy of your Personal Data

You are entitled to request confirmation whether we process any of your Personal Data. Where this is the case, subject to applicable law, you have the right to access to your personal information and to certain information about how it is processed. In some cases you can ask us to provide you with an electronic copy of your information. If there is a self-service system, we really encourage you to access to it and update it yourself.

• Right to correct your Personal Data  

If you can demonstrate that Personal Data we hold about you is not correct, you can request that this data is updated or otherwise corrected, subject to applicable law. If there is a self-service system, we really encourage you to access to it and update it yourself.

• Right to delete/Right to be forgotten

You have the right to request that (some or all off) your Personal Data is deleted, subject to applicable law. Please note that we shall retain any aggregated and de-identified Personal Information that does not identify any individual, as well as any of your information as is necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Please bear in mind that deletion may affect your use of one or all of the LHH services.

• Right to object 

As far as the company’s processing of your data is based on the company’s legitimate interest (and no other processing ground) or relates to direct marketing, you are entitled to object to LHH ’s processing your Personal Data by reference to your particular situation.

• Right to restrict 

In certain circumstances, you have the right to restrict the processing of your Personal Data. However, in some instances such restriction of processing may limit the services that you can receive from us.

• Right to data portability 

You have the right to request a copy of your Personal Data to be used for your own purposes across different services.

In accordance with applicable law, we will take steps to verify your identity and the request before processing any request, including, for example, requiring you to provide identifying information about yourself, your account, your prior interactions with us, and/or such other additional information as may be required by law.
